Case Studies

As in many disciplines, patent law is quite complex, and no one new to the field should begin the process of acquiring a patent portfolio alone.  There is so much to know, and there is always something new developing.

The following case studies describe what happens sometimes when a patent applicant is not properly advised.  The facts have been simplified to make the general concepts more apparent.

  • Case A – Applying for a Patent while Keeping Part of an Invention a Trade Secret
  • Case B – Writing the Specification Without Providing Sufficient Support for the Claims
  • Case C – Drafting a Method Claim that no Single Party would Infringe
  • Case D – Failing to Oppose a Requirement for an Election of Species

These case studies describe only a few of the many unfortunate consequences that can and do occur when patent applicants do not receive proper guidance while applying for patents.  I work to prevent my clients from repeating the mistakes of others by constantly following the ever-changing law and then advising my clients accordingly.

If it interests you to learn also from the mistakes of others, I invite you to contact me to schedule a session where we will examine your patents and patent applications for any weaknesses and, if necessary, discuss how to correct for problems before they occur.
